Disclaimer and Software License Agreement

This Fund Manager Software Disclaimer and License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Beiley Software for Beiley Software's Fund Manager computer software (the "Software").  By continuing to use the Software, you agree to be bound by all terms of this Agreement.

1. EVALUATION PERIOD

The Software is provided at no charge to the user for an evaluation period.  If you would like to continue using the Software after the evaluation period, you must purchase a license.  Any data entered into the evaluation version continues to be available in the licensed version.

2. WARRANTY

The Software is supplied as is.  Beiley Software disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose.

3. DISCLAIMER OF DAMAGES

Beiley Software assumes no liability for damages, direct or consequential, which may result from the use of the software.

4. MULTI-COMPUTER USE

A single license may be used on up to three computers for a single user.  Using the Software on additional computers by different users requires a separate license for each user.

5. REFUNDS

Purchase of a software license includes a 100% unconditional 30-day money-back guarantee.  Beiley Software guarantees you'll be delighted with Fund Manager and that it will run bug-free on your computer, or you'll receive a prompt, full refund upon request.  Refund requests past the 30 day period are up to the sole discretion of Beiley Software.

6. COPYRIGHT

The Software is owned by Beiley Software and is protected by United States copyright laws and international treaty provisions.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.  YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND BEILEY SOFTWARE WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN YOU AND BEILEY SOFTWARE OR BEILEY SOFTWARE'S AGENT(S) RELATING TO THE LICENSED SOFTWARE.
