I've noticed there has been a lot of attention in the news lately about the legality of crawler technology.

eBay is suing Bidders Edge saying their crawler software is 'trespassing'.

"They're essentially engaging in cyber-trespassing," said Kevin Pursglove, an eBay spokesman. "They are trespassing on our site and the information is being gathered illegally."

My question is this. Is it legal for this software to automatically retrieve market data from the various web servers out there without permission?

When this goes to trial it will be a landmark case.
